The agreement
These terms are a contract between you (the business that opens an account) and Wayne Agency, a sole trader based in the United Kingdom, trading as Follow-Up Live. By creating an account or paying for a subscription you agree to them. If you are signing up on behalf of a company, you confirm you have the authority to do so.
Follow-Up Live is a business tool. It is not offered to consumers, and you confirm you are using it for your trade or business.
What the service does
Follow-Up Live connects to a Gmail inbox you choose, spots new customer enquiries, and sends a polite, AI-drafted follow-up from that inbox. It can send a short sequence of follow-ups (for example day 0, 3 and 7) and stops as soon as the lead replies. Nothing sends until you have subscribed, connected Gmail, and turned follow-up on.
We may improve or change how the service works over time. If a change would materially reduce what you are paying for, we will tell you in advance and you may cancel.
Your account
- Keep your password private. You are responsible for activity under your login.
- Give us accurate details and keep them up to date.
- Only connect a Gmail inbox you are entitled to use for your business, and only send follow-ups to people who contacted you or who you are otherwise allowed to email.
- Tell us straight away if you think someone else has access to your account.
Acceptable use
You must not use Follow-Up Live to:
- send unsolicited marketing, spam, or anything that breaks PECR, UK GDPR or Google’s policies;
- send content that is unlawful, misleading, abusive, or infringes someone else’s rights;
- try to access another customer’s workspace, probe our systems, or resell the service without our consent.
We may pause or close an account that breaks these rules. Where we can, we will warn you first.
Subscription, payment and cancelling
New clients start with a 7-day trial. A card is collected at signup and nothing is charged during that week. The first paid invoice after the trial is 30% off once. Later invoices are the agreed monthly price until you cancel. The price is agreed on your custom plan and shown at checkout. Stripe bills it on a recurring basis, in pounds sterling and, where applicable, with VAT. If a payment fails we will retry and email you; follow-up is switched off automatically while a subscription is unpaid and turned back on once payment succeeds. A trial that is running counts as an active subscription, so you can Connect Gmail and turn follow-up on during it.
You can cancel at any time. Your subscription then runs to the end of the period you have already paid for and is not renewed. Because the service is provided immediately and continuously, we do not refund part-used periods, except where the law requires or where we have failed to provide the service.
We may change prices with at least 30 days’ notice by email. The new price applies from your next renewal after the notice period.
AI-drafted emails are yours to check
Follow-ups are written by an AI model using the enquiry and your own writing style. They are sent from your address in your name. You are responsible for what goes out: use the test run, read the follow-up quality panel, rate drafts, and turn follow-up off if you are not happy. AI drafts can be wrong or clumsy from time to time and we cannot promise a particular tone, response rate, or business result.
Your data
You own your emails, your customer data and your account details. You give us permission to process them only to provide the service, as described in our privacy policy. Each customer’s data is kept in a separate workspace. You are responsible for having a lawful basis to email your leads.
Availability and support
We aim to keep Follow-Up Live running around the clock but cannot guarantee it will always be available or error-free. Gmail, Stripe, the AI provider or our hosting may have outages that are outside our control.
Support is provided by email in plain English. To reach us, use the contact details published on this website, or reply to any email you have received from Follow-Up Live.
Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
Otherwise, our total liability to you in any 12-month period is limited to the subscription fees you paid us in that period. We are not liable for loss of profit, loss of business, loss of data, or any indirect loss, even if we were told it might happen.
Ending the agreement
You can close your account at any time by cancelling your subscription and asking us to delete your workspace. We can end the agreement with 30 days’ notice, or immediately if you seriously or repeatedly break these terms. When the agreement ends we disconnect Gmail, stop all follow-ups, and delete your workspace as set out in the privacy policy.
General
- These terms are governed by the law of England and Wales, and its courts have exclusive jurisdiction.
- If part of these terms is found unenforceable, the rest still applies.
- We may update these terms. We will change the date at the top and, for material changes, email account holders at least 14 days before they take effect. Continuing to use the service after that means you accept the new terms.
